Terms of Service

These Terms of Service (“Terms”) form a binding agreement between you and Samuel Henderson, a sole proprietorship operating Boat Guru (the “Service”, “we”, “us”, “our”). By creating an account or using the Service you agree to these Terms and to our Privacy Policy and Disclaimer.

1. The Service

Boat Guru is an AI-powered chatbot that helps recreational boat owners diagnose and troubleshoot marine engine, electrical, fuel, and drive-system issues. Responses are generated by large language models and are general guidance only — not professional advice. See the Disclaimer for the full safety notice.

2. Eligibility

You must be at least 18 years old and able to enter into a binding contract to use the Service. The Service is not directed to children under 13 and we do not knowingly collect personal information from them.

3. Account

You are responsible for the accuracy of the information you provide, for keeping your password confidential, and for all activity that occurs under your account. Notify us at support@boatguru.ai immediately if you suspect unauthorized use.

6. AI-generated output and your responsibility

The Service produces AI-generated guidance that can be incorrect, incomplete, or out of date. You are solely responsible for any action you take based on output from the Service. Always verify safety-critical work — fuel, electrical, steering, through-hulls, fire suppression, lifting an engine — with a certified marine mechanic before performing it. 7. Intellectual property

We own the Service, including all software, design, and original content. You retain ownership of the content you submit (your questions, boat profiles, photos). You grant us a worldwide, non-exclusive license to use, store, and process that content as necessary to operate, secure, and improve the Service. We will not sell your content to third parties or use it to train third-party models.

8. Disclaimer of warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT AI-GENERATED OUTPUT IS ACCURATE, RELIABLE, OR SUITABLE FOR ANY PARTICULAR REPAIR OR DECISION.

9. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL BOAT GURU OR ITS OPERATOR BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST DATA, PROPERTY DAMAGE, PERSONAL INJURY, OR LOSS OF GOODWILL ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL CUMULATIVE LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS OR THE SERVICE IS LIMITED TO THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) USD $50.

10. Indemnification

You agree to indemnify and hold harmless Boat Guru, its operator, and its service providers from any claims, damages, or expenses (including reasonable attorneys' fees) arising from your misuse of the Service, your violation of these Terms, or your violation of any law or third-party right.

11. Termination

You may stop using the Service at any time and delete your account by contacting us. We may suspend or terminate your access if you breach these Terms or for any reason on reasonable notice. Sections of these Terms that by their nature should survive termination (including Sections 6–10 and 13) will survive.

12. Changes to the Service or these Terms

We may update these Terms from time to time. We will post the updated Terms with a new effective date and, for material changes, notify you by email or in-product notice. Your continued use of the Service after the effective date constitutes acceptance.

13. Governing law and dispute resolution

These Terms are governed by the laws of the Commonwealth of Virginia, without regard to its conflict-of-laws rules. Exclusive jurisdiction and venue for any dispute arising from these Terms or the Service will lie in the state and federal courts located in Virginia, and you consent to personal jurisdiction in those courts.
