Terms of Service

These Terms of Service (“Terms”) form a binding agreement between you and Boat Guru, LLC, a Virginia limited liability company (“Boat Guru”, “we”, “us”, “our”), which operates the Boat Guru service (the “Service”). By creating an account or using the Service you agree to these Terms and to our Privacy Policy and Disclaimer.

1. The Service

Boat Guru helps recreational boat owners with whole-boat repairs, maintenance, boat problems, and general boating questions. It uses automated software to prepare answers, which are general guidance only. Boat Guru provides general boat guidance. It is not a certified marine mechanic, emergency service, vessel survey, or a guarantee that a boat is safe to operate. See the Disclaimer for the full safety notice.

2. Eligibility

You must be at least 18 years old and able to enter into a binding contract to use the Service. The Service is not directed to children under 13 and we do not knowingly collect personal information from them.

3. Account

You are responsible for the accuracy of the information you provide, for keeping your password confidential, and for all activity that occurs under your account. Notify us at support@boatguru.ai immediately if you suspect unauthorized use.

4. Subscription, billing, and refunds

• Plans and trial. BoatGuru Plus and Pro each have a 14-day, full-feature trial that requires a payment method. After the trial, Plus is $24.99 monthly or $249.99 yearly (about $20.83 per month, billed annually); Pro is $39.99 monthly or $399.99 yearly (about $33.33 per month, billed annually). Both include unlimited boat help, photo and document uploads, and reports you can share with a mechanic under fair use. Plus includes one saved boat; Pro includes up to five. Current pricing is shown on the Pricing page.
• Fair use. Paid plans are subject to visible fair-use controls for abuse, automation, resale, account sharing, or extreme non-DIY usage. BoatGuru Plus and Pro do not include hidden diagnostic message-count quotas.
• Auto-renewal. Paid subscriptions automatically renew at the end of each billing period at the then-current price unless you cancel before the renewal date through the customer portal accessible from your account.
• Cancellation. You can cancel anytime. Cancellation stops future charges; the subscription continues to provide access through the end of the current paid period.
• Refunds. Subscription fees are generally non-refundable. We may issue refunds at our discretion for billing errors or service outages. Contact support@boatguru.ai.
• Taxes. Prices are exclusive of applicable sales, use, VAT, or similar taxes, which will be added at checkout where required.
• Payment processing. Website payments are processed by Stripe and in-app purchases are processed by Apple. We never receive or store your full card number.

5. Acceptable use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable maritime, environmental, or product-safety regulations.
• Attempt to reverse engineer, scrape, or extract the underlying models or training data, or use the Service to develop a competing product.
• Misuse the Service to generate content that is harmful, harassing, or that infringes another person's rights.
• Submit content you do not have the right to share, including third- party copyrighted service manuals or proprietary OEM data, except as permitted by fair use or by license.
• Abuse rate limits, run automated scripts, or share account credentials beyond reasonable personal use.
• Use consumer BoatGuru Plus or Pro access for commercial fleet management, dealer operations, shop intake queues, technician dispatch, or SLA-style support workflows.

We may suspend or terminate accounts that violate these rules, with or without notice.

6. Boat Guru's answers and your responsibility

The Service can give guidance that is incorrect, incomplete, or out of date. You are solely responsible for any action you take based on output from the Service. Boat Guru does not certify any vessel, repair, route, or operating condition as safe. Always verify safety-critical work — fuel, electrical, steering, through-hulls, fire suppression, lifting an engine — with a certified marine mechanic before performing it. Mechanic handoff reports are summaries for communicating context to a human mechanic; they are not inspections, certifications, or proof that a repair is safe.

• Safety-critical problems need more than ordinary troubleshooting.
• The named high-risk categories are fuel leaks or fuel vapors; fire, smoke, or fire-suppression issues; electrical shorts, battery faults, or burning wiring; steering, throttle, shift, or control loss; carbon monoxide alarms, exhaust intrusion, or poisoning symptoms; sinking, flooding, bilge, through-hull, or buoyancy problems; underway safety issues; hull, deck, transom, mast, rigging, or lifting hazards; trailer, towing, launch, or recovery hazards.
• For an active emergency, get people safe and contact the U.S. Coast Guard on VHF channel 16, local emergency services, or a towing provider before using Boat Guru.
• Call a qualified marine mechanic when the situation is dangerous, uncertain, depends on an exact model or serial number, or cannot be checked with reliable information.
• This is general guidance, not professional advice. For safety-critical repairs, stop and have a qualified marine mechanic verify the work before you continue.

7. Source content, manuals, and PDFs

• Boat Guru may point to manuals, manufacturer pages, forum posts, and other sources. A link does not mean the source can be shared publicly.
• Manual PDF downloads are not offered publicly unless the source rights are explicitly cleared for that use.
• Private user-uploaded manuals stay private to the uploading account and do not create public sharing or redistribution rights.
• Sources that are not clearly available to share will not be republished as long excerpts or downloads.

You are responsible for ensuring you have the right to upload or share any content you submit. We may refuse, remove, block, or limit use of source material when rights are unclear, a source asks us not to use it, or public redistribution would be inappropriate.

8. Intellectual property

We own the Service, including all software, design, and original content. You retain ownership of the content you submit (your questions, boat profiles, photos, uploaded manuals, and generated handoff reports). You grant us a worldwide, non-exclusive license to use, store, and process that content as necessary to operate, secure, and improve the Service. We will not sell your content to third parties or use it to train third-party models.

9. Disclaimer of warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT AI-GENERATED OUTPUT IS ACCURATE, RELIABLE, OR SUITABLE FOR ANY PARTICULAR REPAIR OR DECISION.

10. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL BOAT GURU, LLC OR ITS SERVICE PROVIDERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST DATA, PROPERTY DAMAGE, PERSONAL INJURY, OR LOSS OF GOODWILL ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL CUMULATIVE LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS OR THE SERVICE IS LIMITED TO THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) USD $50.

11. Indemnification

You agree to indemnify and hold harmless Boat Guru, LLC and its service providers from any claims, damages, or expenses (including reasonable attorneys' fees) arising from your misuse of the Service, your violation of these Terms, or your violation of any law or third-party right.

12. Termination

You may stop using the Service at any time and delete your account at /account/delete, or by contacting us if you cannot sign in. We may suspend or terminate your access if you breach these Terms or for any reason on reasonable notice. Sections of these Terms that by their nature should survive termination (including Sections 6-11 and 14) will survive.

13. Changes to the Service or these Terms

We may update these Terms from time to time. We will post the updated Terms with a new effective date and, for material changes, notify you by email or in-product notice. Your continued use of the Service after the effective date constitutes acceptance.

14. Governing law and dispute resolution

These Terms are governed by the laws of the Commonwealth of Virginia, without regard to its conflict-of-laws rules. Exclusive jurisdiction and venue for any dispute arising from these Terms or the Service will lie in the state and federal courts located in Virginia, and you consent to personal jurisdiction in those courts.
